A recent prosecution in Dorset has brought this into sharp focus, highlighting the serious consequences when fire safety responsibilities aren’t fully met.
What Happened?
A care home in Boscombe, Dorset, Portelet Manor, has been fined £70,000 following fire safety failings linked to the tragic death of a vulnerable resident.
The incident took place on 19 June 2023, when a resident suffered significant burns while smoking in a designated smoking area. They sadly passed away in hospital 11 days later.
Following the incident, Dorset and Wiltshire Fire and Rescue Service (DWFRS) launched an investigation. The care home operator, Portelet Manor Limited, later pleaded guilty to breaching the Regulatory Reform (Fire Safety) Order 2005.
The court found that the business had failed to ensure appropriate fire safety arrangements were in place—putting residents at risk of serious harm or death.
In addition to the £70,000 fine, the company was ordered to pay:

£22,000 in costs

A £2,000 victim surcharge

DWFRS made it clear that this case should act as a warning.
Fire Safety Prosecution Manager Tom Huntley stated that while the service is committed to supporting businesses, enforcement action will be taken where there are serious failings.
